| TRUST AND GOODWILL ARE THE GOALS |
The SendPilot system is designed to embody the concepts of Permission Marketing as described in Seth Godin's book 'Permission Marketing'. If used properly, SendPilot helps businesses build two-way communications based on TRUST and GOODWILL with their customers and prospects. Permission Marketing opt-in messages are anticipated and/or welcomed by recipients. Unsolicited SPAM messages are not only annoying, but negate the principles of Permission Marketing.
PilotTools does not attempt to censor or curtail the business decisions of clients. But as a whole, SPAMming hurts reputations more than it helps the SPAMmer. Do yourself, and us, a favor. DON'T DO IT. The following are definitions and examples of SPAM which are blatantly contrary to the SendPilot Service Agreement.

| SPAM: |
| Defined as sending unsolicited commercial e-mail. SPAMming is strictly prohibited. Clients are not permitted to use SendPilot to send unsolicited commercial e-mail. If you received a mailing from SendPilot, your email address is either listed as someone who has expressly shared this address for the purpose of receiving information in the future ("opt-in"), or you have registered, purchased or otherwise have an existing relationship with the originator. |

| PURCHASED or 'HARVESTED' LISTS |
| Mass mailing to a purchased mailing list is not allowed through SendPilot. To comply with our No-SPAM policy, the recipients of mailings through SendPilot must have specifically requested (subscribed) to receive mail from the originator. Purchased or inherited lists are, by definition, NOT opt-in. |

| EASY OPT-OUT: |
| All communications issued through SendPilot must include instructions to unsubscribe (opt-out) in every message. THE CONSEQUENCES: We take a very dim view of SPAM and will take action immediately. If we find that a SendPilot client has violated our No-SPAM Policy, we will disable the account and report the incident to the proper local, state, and federal authorities as necessary. |

| HARASSMENT: |
| Defined as sending continued communication after being requested to stop. Threatening or harassing e-mail is strictly prohibited through SendPilot. Emails that embarrass, defame, abuse, threaten, are libelous or slanderous are also prohibited. |

| MORALITY CLAUSE: |
| MORALITY CLAUSE: We will not conduct business with users whose content contains or links to pornographic or sexually explicit content, racially or ethnically objectionable content, or content that violates laws or promotes illegal activities of any kind. We also reserve the right to decline work at our discretion in case we meet someone whose site admonishes excessive political views which might lead to a state of war. |

| OFF-TOPIC MAILING: |
| Additionally, the recipients must have specifically
requested (subscribed) to receive mail on this topic. For
example, clients cannot start a list about vacation
destinations and then post to it about home mortgages. |

| REPORTING SPAM: |
| If you believe that you have received SPAM from
SendPilot's network, please send a signed complaint from
your e-mail account along with the abusing message and
complete headers to abuse@pilottools.com.
PilotTools does not investigate or take actions based
on "anonymous" SPAM complaints.

| THE CONSEQUENCES: |
We take a very dim view of SPAM and will take action immediately. If we find that a Licensee has violated our No-SPAM Policy, we will disable the account and report the incident to the proper local, state, and federal authorities as necessary.
Recipients of mailings through PilotTools services agree to hold PilotTools harmless from any damages or claims arising from any violation of this policy.
